苏州市献血条例


(1999年1月15日苏州市第十二届人民代表大会常务委员会第八次会议制定


1999年4月8日江苏省第九届人民代表大会常务委员会第九次会议批准)


第一章总则


第一条为保证本市医疗临床用血的需要和安全,保障献血者和用血者的身体健康,发扬救死


扶伤的人道主义精神,根据《中华人民共和国献血法》等法律,结合本市实际情况,制定本条例。


第二条本条例适用于本市行政区域内的公民、法人和其他组织。


第三条本市依法实行无偿献血制度。提倡十八周岁至五十五周岁(以下称适龄)的健康公民


自愿献血。


第四条各级人民政府领导本行政区域内的献血工作,保证献血工作经费,组织开展献血的宣


传教育,统一规划并组织、协调有关部门共同做好献血工作。


第五条市和县级市、区人民政府卫生行政部门是本行政区域内献血工作的主管部门。


第六条广播电视、新闻出版、文化、教育、科技等有关部门应当配合卫生行政部门组织开展


献血的宣传教育。


新闻媒介应当定期义务开展献血的社会公益性宣传。


学校应当开展献血知识教育。


第七条各级红十字会应当协助同级人民政府和卫生行政部门开展献血的宣传、动员、表彰工


作。


工会、共青团、妇联、科协等社会团体,应当协助做好献血工作。






第二章献 血 管 理






第八条市、县级市卫生行政部门负责拟定本行政区域内的年度献血计划,报同级人民政


府批准后下达。


第九条国家机关、社会团体、企业事业组织、居民委员会、村民委员会应当动员和组织本单


位或者本居住区的适龄公民参加献血,保证献血计划的完成。


第十条对完成上年度献血计划的单位和居民委员会、村民委员会发给市人民政府印制的《完


成献血计划证》。


第十一条鼓励国家工作人员、现役军人和高等学校在校学生率先献血。


第十二条公民可以参加所在单位组织的献血活动,也可以直接到中心血站、基层血站或者中


心血库(以下统称血站)及其设置的采血点或者流动采血车献血其献血量计入所在单位年度献血


计划的完成数内。


无工作单位的公民可以参加所在居民委员会、村民委员会组织的献血活动,也可以直接到血站及其


设置的采血点或者流动采血车献血,其献血量计入所在居民委员会、村民委员会年度献血计划的完


成数内。


对献血者,发给国务院卫生行政部门制作的《无偿献血证》。


第十三条禁止非法组织他人出卖血液。


禁止单位和个人雇佣他人献血和冒名献血。






第三章采血和供血管理






第十四条血站是采集、提供医疗临床用血的机构,是不以营利为目的的公益性组织。


第十五条血站必须获得省卫生行政部门批准颁发的《血站执业许可证》或者《中心血库采供


血许可证》方可从事采血、供血活动。


血站应当按照许可证核定的执业范围从事业务活动。


第十六条血站必须按照国务院卫生行政部门制定的《献血者健康检查标准》,对献血者免费


进行健康检查。检查不合格的,不得采集血液。


血站对适龄期不适合献血的公民,应当发给市卫生行政部门印制的《不适合献血证明》。


第十七条血站对献血者每次采血量一般为二百毫升,最多不得超过四百毫升,两次采集间隔


期不少于六个月。禁止对献血者超量、频繁采集血液。


第十八条血站采血时必须由具备采血资格的医务人员严格按照采血技术规范和操作规程进行,并使


用符合国家标准的一次性采血器材。


血站采血后,应当严格按照《献血者健康检查标准》对采集的血液进行检测。未经检测或者检测不


合格的血液,不得向医疗机构提供。对血液的分离、包装、储存、运输,必须符合国家规定的标准


和要求。


第十九条医疗机构应当根据医疗临床用血需要,制定用血计划,报市、县级市卫生行政部门


审核同意后,由血站供血。


第二十条医疗机构应当到本行政区域内的血站或者市卫生行政部门指定的血站领取血液,并


严格遵守血液储存管理制度。


医疗机构应当按照国家规定对医疗临床用血进行核查,未经核查或者核查不符合国家规定标


准的血液,不得用于医疗临床。


医疗机构临床用血应当执行输血技术规范,遵循合理、科学的原则,积极推行按血液成份针


对医疗实际需要输血,提倡并指导择期手术患者自身储血,不得浪费和滥用血液。


医疗机构供血前,应当核对公民持有的有关用血证明和证件。


第二十一条无偿献血的血液必须用于临床,不得买卖。






第四章用 血 管 理










第二十二条本市实行公民个人储血、家庭互助、单位互助和社会援助相结合的用血制


度。


第二十三条公民医疗临床用血时,应当按照国家统一制定的收费标准,交付用于血液采集、


储存、分离、检验等费用(以下简称医疗临床用血费用)。


第二十四条献血者医疗临床用血时,凭本人《居民身份证》和《无偿献血证》,按照其献血


量的三倍计量免费用血;献血者的配偶和直系亲属医疗临床用血时,按照献血者献血量的等量免费


用血。


在本市献血量累计一千毫升以上的公民,本人终身免费用血。


献血者本人或者配偶和直系亲属在外地的医疗临床用血费用,可以回本地按照有关规定报销。


第二十五条符合献血条件的有工作单位的公民医疗临床用血时,本人或者配偶和直系亲属未


献血,本人所在单位又未完成上年度献血计划的,应当交付用血互助保证金;符合献血条件的无工


作单位的公民医疗临床用血时,本人或者配偶和直系亲属未献血,本人所在居民委员会、村民委员


会又未完成上年度献血计划的,应当交付用血互助保证金。用血互助保证金为医疗临床用血费用的


两倍。


公民本人或者配偶和直系亲属自交付用血互助保证金之日起一年内在本市献血的,其交付的用血互


助保证金予以退回。


用血互助保证金由市、县级市卫生行政部门管理,财政部门监督。


第二十六条十八周岁以下(不含十八周岁)、五十五周岁以上(不含五十五周岁)的公民和


持有《不适合献血证明》的公民,医疗临床用血免交用血互助保证金。


第二十七条急救病人需要医疗临床用血的,医疗机构应当先提供所需血液,病人家属或者其


所在单位必须按照本条例规定补办用血手续。


第二十八条《无偿献血证》、《完成献血计划证》和《不适合献血证明》不得伪造、涂改、


出卖、转让和出借。






第五章奖励和处罚










第二十九条对有下列情形之一的,由各级人民政府给予表彰、奖励:


(一)献血累计一千毫升以上的个人;


(二)超额完成年度献血计划的单位和组织;


(三)在献血宣传、教育、组织发动工作中成绩显著的单位、组织和个人;


(四)在医疗临床用血新技术的研究和推广中成绩显著的单位和个人;


(五)在献血、采血、供血和用血管理工作中作出显著成绩的单位和个人;


(六)对献血事业捐资或者作出特殊贡献的单位、组织和个人。


第三十条对未完成献血计划的单位和组织,由卫生行政部门责令其限期完成,逾期未完成


的,同级人民政府或者有关部门可以给予通报批评。


第三十一条伪造、涂改、出卖、转让、出借《无偿献血证》、《完成献血计划证》和《不适


合献血证明》的,由卫生行政部门没收证件和违法所得,并处以一百元以上一千元以下罚款。


雇佣他人献血,或者冒名献血的,由卫生行政部门对单位处以五千元以上一万元以下罚款;


对个人处以五百元以上一千元以下罚款。所在单位或者上级主管部门应当对有关责任人员给予行政


处分。


第三十二条违反本条例规定,有下列行为之一的,由卫生行政部门予以取缔,没收违法所


得,可以并处一万元以上五万元以下罚款;情节严重的,处以五万元以上十万元以下罚款;构成犯


罪的,依法追究刑事责任:


(一)非法采集血液的;


(二)出售无偿献血的血液的;


(三)非法组织他人出卖血液的。


第三十三条血站违反操作规程和制度采集血液的,由卫生行政部门责令改正;给献血者健康


造成损害的,应当依法赔偿,对直接负责的主管人员和其他直接责任人员,依法给予行政处分;构


成犯罪的,依法追究刑事责任。


血站对医疗临床用血的检测、分离、包装、储存、运输,不符合国家规定的卫生标准和要求


的,由卫生行政部门责令改正,给予警告,可以并处一千元以上一万元以下罚款。


血站向医疗机构提供的血液不符合国家规定标准的,由卫生行政部门责令改正;情节严重


的,限期整顿,对直接负责的主管人员和其他直接责任人员,依法给予行政处分;构成犯罪的,依


法追究刑事责任。


第三十四条医疗机构将不符合国家规定标准的血液用于患者的,由卫生行政部门责令改正;


给患者健康造成损害的,应当依法赔偿,对直接负责的主管人员和其他直接责任人员,依法给予行


政处分;构成犯罪的,依法追究刑事责任。


第三十五条当事人对行政处罚决定不服的,可以依法申请复议或者提起诉讼。当事人逾期不


申请复议,也不提起诉讼,又不履行行政处罚决定的,由作出处罚决定的机关申请人民法院强制执


行。


第三十六条卫生行政部门及其工作人员在献血、用血的监督管理工作中玩忽职守、滥用职


权、徇私舞弊的,依法给予行政处分;构成犯罪的,依法追究刑事责任。






第六章附则










第三十七条外来暂住人员适用本条例。


外地来本市就医的公民需要医疗临床用血的,参照本条例有关规定执行。


第三十八条在本市的外国公民、华侨、香港特别行政区居民、澳门地区居民和台湾地区居民


可以凭有效身份证件参加献血,享受本市公民同等的用血待遇;本人没有参加献血需要医疗临床用


血的,凭本人有效身份证件用血,交纳医疗临床用血费用。


第三十九条本条例自1999年5月1日起施行。

  Ordinance may be cited as the Protection of Wages on 
Insolvency
  nance.
  nterpretation
  his Ordinance, unless the context otherwise requires--
  licant" means any person who would, on the winding up of a company,
be
  tled to priority under section 265 (1) (b), (c), (ca) or (cc) of

 PART II PROTECTION OF WAGES ON INSOLVENCY FUND BOARD
  
  stablishment and incorporation of Wages on Insolvency Fund Board
  There is hereby established a board to be known as the Protection 
of
  s on Insolvency Fund Board and in the Chinese language as which 
shall
  body corporate.
  The Board shall consist of a Chairman appointed under the Schedule
and
  more than 10 members appointed by the Governor as follows--
  subject to paragraph (b) not more than 4 public officers;
  equal numbers of persons who, in his opinion, represent employers 
and
  ons who, in his opinion, represent employees.
  The Governor shall give notice of each appointment by notice in 
the
  tte.
  The Schedule shall have effect with respect to the Board.
  unctions and powers of the Board
  The Board shall have the following functions--
  to administer the Fund;
  to make recommendations to the Governor with respect to the 
rate of
  ; and
  to perform such other duties as are imposed or other powers as 
are
  erred on it by this Ordinance.
  The Board may do all such things as are necessary for, or 
incidental
  onducive to, the better carrying out of the functions of the Board
and
  in particular, but without prejudice to the generality 
of the
  going--
  hold, acquire or lease all kinds of property whether 
movable or
  vable;
  sell or otherwise dispose of all kinds of property whether movable 
or
  vable;
  subject to section 10, invest its funds in such manner and to 
such
  nt as it thinks necessary or expedient; and
  with the prior consent of the Financial Secretary, borrow 
money in
  manner and on such securities or terms as it thinks expedient.

 PART III FUND

  e shall be paid from the Fund the following--
  payments to applicants under section 16;
  expenses incurred by the Board for the purposes of this Ordinance;
  capital, interest and charges in respect of any loan; and
  any other sums required or permitted to be paid by the Fund under
this
  nance.
 PART IV FINANCIAL PROVISIONS
  
  inancial year and estimates
  The Board may, from time to time, with the prior approval 
of the
  rnor, fix a period to be the financial year of the Fund.
  In each financial year, before a date to be fixed by the Governor,
the
  d shall submit to the Governor, for his approval, estimates 
of the
  me and expenditure of the Fund for the next financial year:
  ided that the estimates for the first financial year of the Fund
shall
  ubmitted as soon as practicable after the commencement 
of this
  nance.
  The Governor shall consider the estimates submitted to 
him under
  ection (2) and may approve or reject them and, in the 
case of
  ction, may require the Board to resubmit the estimates 
modified in
  manner and within such time as the Governor may direct.
  The Board may, from time to time, vary the estimates approved 
under
  ection (3) and shall, as soon as practicable, deliver to the 
Governor
  atement in writing containing details of any variation.
  ank account
  Board shall open and maintain an account with a bank approved by 
the
  ncial Secretary and shall pay all moneys of the Fund 
into that
  unt.
  Investment of moneys
  moneys of the Fund that are not immediately required by the Board 
may
  
  deposited on fixed term or call deposit or in a savings account
in
  bank licensed under the Banking Ordinance (Cap. 155); or
  with the prior approval of the Financial Secretary, invested in 
such
  r investments as the Board thinks fit.
  Accounts
  Board shall--
  keep and maintain such accounts and records of all transactions
of the
  as the Director of Accounting Services may require; and
  after the end of each financial year cause to be prepared a 
statement
  he accounts of the Fund which shall include an income and 
expenditure
  unt and balance sheet and shall be signed by the Chairman.
  Auditors
  The Board shall at the commencement of each financial year 
appoint
  tors, who shall be entitled to have access to all books of 
account,
  hers and other records kept by the Board and to 
require such
  rmation and explanations as they may think fit.
  The auditors shall audit the statement of accounts prepared 
under
  ion 11 and shall report thereon to the Board.
  Statements and reports to be laid on table of Legislative Council
  The Board shall, within 6 months after the end of each financial 
year
  uch further time as the Governor may for any particular year 
allow,
  it to the Governor a report on the activities of the Board for 
that
  ncial year including copies of the statement of accounts 
prepared
  r section 11 and the report made under section 12.
  The Governor shall cause the reports and statements received 
by him
  r subsection
  to be laid on the table of the Legislative Council.
  Costs of administering the Fund
  All costs and expenses incurred by the Government in
administering the
  shall be a charge upon general revenue.
  The Financial Secretary may direct that a supervision fee 
to be
  rmined by him, in relation to such period as may be determined
by him,
  l be charged against the income of the Fund and shall at a 
time
  rmined by him be paid to him by the Board from the Fund and paid 
by
  into general revenue.
 PART V PAYMENT FROM THE FUND
  
  Entitlement to apply for ex gratia payment
  Subject to this Part, an applicant to whom--
  wages are due and unpaid;
  wages in lieu of notice are due and unpaid; or
  the liability to be paid a severance payment has arisen 
and the
  rance payment is unpaid, whether or not the severance payment is 
then
  may apply for an ex gratia payment from the Fund in respect of 
the
  s, wages in lieu of notice or the severance payment, as the case 
may
  or all or any of them. (Replaced 38 of 1989 s. 3)
  An application under subsection (1) (in this Part called an
  lication" ) shall be made to the Commissioner in writing in a 
form

  No applicant shall apply for payment from the Fund in respect of 
any
  s for services rendered before 1 April 1985.
  No applicant shall apply for payment from the Fund in respect of
wages
  ieu of notice arising out of a contract of employment 
terminated
  re the commencement of the Protection of Wages on Insolvency
  ndment) Ordinance 1987 (48 of 1987). (Added 48 of 1987 s. 3)
  No applicant shall apply for payment from the Fund in respect 
of a
  rance payment the liability for payment of which arose 
before the
  encement of the Protection of Wages on Insolvency 
(Amendment)

  Payment
  Subject to subsections (1B) and (2) where it appears 
to the
  issioner that an employer has failed to pay any wages, wages in 
lieu
  otice or severance payment, as the case may be, or all or any of 
them
  n applicant and that--
  in the case of an employer who is not a company--
  a bankruptcy petition has been presented against him; or
  he has committed an act of bankruptcy within the meaning of
section 3
  he Bankruptcy Ordinance (Cap. 6) but a petition cannot be 
presented
  nst him by reason of section 6 (1) (a) of that Ordinance; or

  in the case of an employer who is a company, a winding-uppetition

  When the Commissioner makes a payment under subsection (1) (a) 
(ii),

  Where an application has been made in respect of a severance 
payment

Commissioner may
  r consideration of the application until the severance payment

  The Commissioner shall not make any payment under subsection
(1)--
  to the applicant unless the applicant has verified his
application by
  atutory declaration in a form approved by the Commissioner;
  ) of an amount exceeding $18,000 in respect of wages; (Replaced

  in respect of wages for services rendered more than 4 months prior 
to
  date of application;
  in respect of wages in lieu of notice--

  the equivalent of 1 month's wages of the applicant; or

  subject to subsection (2A), which became due more than 4 months

  Subsection (2) (e) (ii) shall not apply to wages in lieu of 
notice

  Review by Board
  Any applicant aggrieved by any decision of the Commissioner 
under
  ion 16 may in writing--
  request the Commissioner to give reasons for that decision; and
  after being given reasons under paragraph  (a), 
request  the
  issioner to refer the application to the Board.
  Upon receiving a request from an applicant under subsection (1) 
(b),
  Commissioner shall forward all documents relating to the 
application
  he Chairman of the Board.
  The Board may confirm or vary any decision of the Commissioner 
on an
  ication referred to it under this section or may for those 
purposes
  ire the Commissioner to make further inquiries relating 
to the
  ication.
  Additional power of Commissioner
  Notwithstanding that in any particular case a petition referred
to in
  ion 16 (1) (a) (i) or (b) has not been presented against an 
employer,
  Commissioner may, subject to subsection (2) of that section, 
make an
  ratia payment under that section in that case if in his opinion--

  sufficient evidence exists to support the presentation of a

  if the employer is a company, that he is unable to pay his debts;

  Where the Commissioner exercises his discretion under 
subsection (1)

重庆市人民政府关于印发重庆市监察机关行政处分审批权限规定的通知



各区县(自治县、市)人民政府,市政府各部门,有关单位:

《重庆市监察机关行政处分审批权限规定》已经2005年5月19日市政府第53次常务会议审议通过,现印发给你们,请遵照执行。

重庆市监察机关行政处分审批权限规定



第一条 为了加强行政监察,保证监察机关行政处分工作的正常进行,根据《中华人民共和国行政监察法》、《中华人民共和国行政监察法实施条例》和有关规定,结合本市实际,制定本规定。

第二条 经本市监察机关立案调查,认为下列人员有违法违纪行为应给予行政处分的,由本市监察机关按本规定行使行政处分权:

(一)本市国家公务员;

(二)本市国家行政机关任命的其他人员。

第三条 市监察局对被监察人员作出给予行政处分的监察决定,按照下列规定进行:

(一)给予由市人大常委会决定任命的本级人民政府各部门领导人员和区县(自治县、市,下同)人民代表大会及其常务委员会选举或者决定任命的区县人民政府领导人员警告、记过、记大过、降级处分的,由市监察局向市人民政府提出处分意见,经批准后,由市监察局下达监察决定;给予撤职、开除处分的,由市监察局提出处分意见,报市人民政府同意,并由市人民政府或者交由区县人民政府提请同级人民代表大会罢免职务,或者向同级人大常委会提请免去职务或者撤销其职务后,由市监察局下达监察决定。

(二)给予市人民政府任命的人员警告、记过、记大过、降级处分的,由市监察局直接作出监察决定,报市人民政府备案;给予撤职、开除处分的,市监察局向市人民政府提出处分意见,经批准后,由市监察局下达监察决定。

第四条 给予市人民政府各部门任命的人员行政处分,由市监察局立案调查的,市监察局可直接作出监察决定;也可责成市人民政府各部门处理。

市人民政府各部门监察机构立案调查的,由该监察机构提出意见,所在部门作出处分决定。

第五条 区县监察局对被监察人员作出给予行政处分的监察决定,按照下列规定进行:

(一)给予区县人大常委会任命的政府各部门人员警告、记过、记大过、降级处分的,由区县监察局向本级人民政府提出处分意见,经批准后,由区县监察局下达监察决定;给予撤职、开除处分的,由区县监察局提出处分意见,报本级人民政府同意,由区县人民政府提请本级人大常委会免去职务或者撤职后,由区县监察局下达监察决定。

(二)给予区县人民政府任命的人员警告、记过、记大过、降级处分的,由区县监察局直接作出监察决定,报区县人民政府备案;给予撤职、开除处分的,由区县监察局报本级人民政府批准后,由区县监察局下达监察决定。

第六条 区县监察局给予乡镇人民政府正副乡长、正副镇长行政处分,按照下列规定进行:

(一)给予警告、记过、记大过、降级处分的,由区县监察局直接作出监察决定,报区县人民政府备案;

(二)给予撤职、开除处分的,由区县监察局提出处分意见,报本级人民政府同意,交由乡镇人民代表大会罢免职务后,由区县监察局下达监察决定。

第七条 给予区县人民政府各部门任命的人员和乡镇政府任命的工作人员警告、记过、记大过、降级、撤职处分,由区县监察局直接作出监察决定;给予开除处分的,应当报区县人民政府批准后,由区县监察局下达监察决定。

第八条 市监察局对直接调查属区县监察局管辖的人员,可直接行使处分权,也可以交由区县监察局依职权作出行政处分决定。

第九条 对下列人员的行政处分,由市监察局报监察部备案:

(一)市人大常委会任命的市政府及其各部门的工作人员;

(二)区县长。

第十条 对下列人员的行政处分,由市政府各部门监察机构或者区县监察局报市监察局备案:

(一)市政府各部门任命的正、副处长受到撤职以上处分的。

(二)区县人大常委会和政府任命的工作人员,乡镇人民政府正副乡长、正副镇长受到撤职以上处分的。

第十一条 本规定由市监察局负责解释。

第十二条 本规定自印发之日起施行。原《重庆市人民政府批复市监察局〈关于行政纪律处分审批权限的请示〉的通知》(重府发〔1998〕55号)和《重庆市人民政府办公厅关于印发〈重庆市行政机关市管干部行政处分审批办法〉的通知》(渝办发〔2001〕128号)同时废止。
